term='nepasare'/><title type='text'>Ignoranta colectiva</title><content type='html'>Chiar daca nu are legatura cu manipularea si cu afacerile, vreau sa va prezint o situatie speciala unde Legea "dovezii sociale" intra in joc intr-un mod dramatic. &lt;br /&gt;Citim adesea in ziar despre cineva caruia i s-a facut rau pe strada sau a fost atacat de un agresor sau a avut un accident si ca nimeni dintre cei care au observat scena nu a intervenit in ajutorul lui (in aceste cazuri, ziaristii scriu despre "egoism metropolitan", "societate bolnava", "criza valorilor" s.a.m.d.). &lt;br /&gt;Dar in alte situatii similare oamenii intervin fara nici o ezitare. Care este explicatia? &lt;br /&gt;&lt;a name='more'&gt;&lt;/a&gt;&lt;br /&gt;Cum am mai spus, Legea "dovezii sociale" are un efect maxim atunci cand situatia este ambigua:&lt;br /&gt;Tipul care sta intins pe trotoar are un atac de cord sau este doar betiv care doarme? Baiatul ala care o deranjeaza pe fata este prietenul ei care glumeste sau un maniac care vrea sa o violeze? Ceea ce vad este un jaf la o banca sau o scena pentru un film? Oamenii aceia chiar se bat sau sunt actori de la emisiunea "camera ascunsa"?. &lt;br /&gt;Cum nu ne place sa ne facem de ras, nu actionam pana nu vedem ce fac ceilalti; daca nimeni nu se misca, facem si noi la fel, fara sa ne gandim ca ceilalti se uita la noi pentru acelasi motiv. Se formeaza astfel starea de "ignoranta colectiva", adica acea stare in care fiecare hotaraste ca, din moment ce nimeni nu face nimic, totul este in regula. &lt;br /&gt;Omului cazut pe trotuar poate ca ii este rau si, daca am fi fost singuri, am fi intervenit imediat, dar asa suntem influentati de calmul aparent al celorlalti. &lt;br /&gt;Iata ce trebuie facut daca ne trezim intr-o situatie de urgenta in public:&lt;br /&gt;-trebuie sa reducem cat de puternic incertitudinea celor prezenti, facand o cerere precisa, directa, unui singur individ. Astfel, daca ni se face rau pe strada, trebuie sa cerem ajutor intr-un mod nu numai foarte clar, dar si foarte precis: &lt;br /&gt;"Va rog, repede, dvs. cu sacou albastru, chemati o ambulanta!". &lt;br /&gt;Asta pune trecatorul in rolul de salvator si probabilitatea de a primi ajutor creste; mai mult Legea "dovezii sociale" functioneaza acum in sensul pozitiv: &lt;br /&gt;vazand ca cineva intervine, si ceilalti vor proceda la fel. &lt;br /&gt;Cum am mai spus, asta nu are legatura cu afacerile, dar poate insemna sfatul cel mai pretios pe care l-ati primit de la mine. Ce faceti? Evident, va uitati si voi in sus; &lt;br /&gt;- la birou se face o cheta pentru o colega care se casatoreste. Prima intrebare care va vine in minte este: "Cat au pus ceilalti?"; &lt;br /&gt;&lt;div style="border-bottom: medium none; border-left: medium none; border-right: medium none; border-top: medium none;"&gt;- trebuie sa va duceti la o petrecere. Cum va imbracati, cu ceva comod sau "la tol festiv"? Pentru a hotari dati cateva telefoane altor invitati; &lt;br /&gt;&lt;/div&gt;&lt;div style="border-bottom: medium none; border-left: medium none; border-right: medium none; border-top: medium none;"&gt;- nu cred ca este nevoie sa dau exemplul modei, un domeniu in care Legea "dovezii sociale" isi gaseste aplicatia cea mai evidenta. &lt;br /&gt;&lt;/div&gt;&lt;a name='more'&gt;&lt;/a&gt;&lt;br /&gt;Modalitati de manipulare prin Legea "dovezii sociale" &lt;br /&gt;Legea "dovezii sociale" ne permite sa infruntam un mare numar de situatii fara sa ne gandim prea mult la ce este bine si ce este rau. &lt;br /&gt;Problemele apar atunci cand datele sunt deliberat falsificate pentru a ne da impresia ca o gramada de persoane se comporta intr-un anumit mod, binenteles, pentru a se obtine ceea ce se doreste de la noi. &lt;br /&gt;Cateva exemple: &lt;br /&gt;&lt;div style="border-bottom: medium none; border-left: medium none; border-right: medium none; border-top: medium none;"&gt;- in toate ocaziile cand va cere bani, un profesionist o sa va arate si cat de mult au dat atii, astfel incat sa va simtiti "stimulati" sa faceti la fel. In aceasta idee, n-o sa vedeti niciodata un cersetor cu palaria goala.; &lt;br /&gt;&lt;/div&gt;- cand o anumita actiune necesita voluntari, pe cat de greu va oferiti primii, pe atat de usor va oferiti dupa ce altii au facut acest pas; asa ca manipulatorul va pregati dinainte un mic grup de "voluntari"...; &lt;br /&gt;&lt;div style="border-bottom: medium none; border-left: medium none; border-right: medium none; border-top: medium none;"&gt;- citind rezultatele unui sondaj pre-electoral si afland 70% din populatie vor vota pentru candidatul X (lucru neadevarat, probabil), foarte multi indecisi se hotarasc sa voteze tot cu X (din acest motiv, in unele tari sondajele dinaintea alegerilor sunt interzise). &lt;br /&gt;&lt;/div&gt;Dar exemplu cel mai bun de manipulare folosind Legea "dovezii sociale" ne este dat de publicitate. &lt;br /&gt;Numesc doar trei situatii: &lt;br /&gt;1) interviuri in care persoane alese "la intamplare" ridica in slavi calitatile unui produs; &lt;br /&gt;&lt;div style="border-bottom: medium none; border-left: medium none; border-right: medium none; border-top: medium none;"&gt;2) folosirea unor celebritati care-si dau cu parerea (pozitiva, desigur) despre produsul X sau Y(si cineva ar trebui sa-mi explice de ce un fotbalist sau un actor ni se pare mai competent ca noi in materie de detergenti sau deodorante...); &lt;br /&gt;&lt;/div&gt;&lt;div style="border-bottom: medium none; border-left: medium none; border-right: medium none; border-top: medium none;"&gt;3) punerile in scena dupa modelul american, unde prezentatorul arata "produsul secolului" (de fiecare data produsul este altul), iar publicul scoate urlete de entuziasm, descoperind cum poate zugravii fara bidinea, cum poate fierbe legumele fara apa sau cum poate sa dea burta jos fara sa faca nimic. &lt;br /&gt;&lt;/div&gt;Ceea ce ma sperie este falsitatea evidenta acestor programe. Profesionistii care le fac stiu perfect ca nu merita sa faca ceva mai bun, fiindca principiul "dovezii sociale" functioneaza automat, indiferent cat de artificiala sau ridicola ni se pare situatia. "publica". &lt;br /&gt;Un exemplu banal: de cate ori intr-o discutie ne-am aparat punctul de vedere, chiar daca argumentele interlocutorului erau superioare, doar pentru a pastra coerenta cu ceea ce am declarat la inceput? &lt;br /&gt;De cate ori facem ceva care nu ne place sau nu ne convine, pur si simplu pentru ca asa am promis? &lt;br /&gt;Mecanismul fiind asa de puternic, nu este de mirare ca profesionistii manipularii profita cat pot de el. Un vanzator care isi cunoaste meseria, inainte de a cere ceea ce vrea sa obtina de la voi, o sa va puna in situatia de a face niste afirmatii pe baza carora o sa-i fie foarte usor apoi sa va impinga in directia dorita (tehnica "celor patru ziduri"): &lt;br /&gt;Vanzatorul: Credeti ca pregatirea scolara este importanta pentru copiii dvs.? &lt;br /&gt;Victima: Da. &lt;br /&gt;Vanzatorul: Va ganditi ca cine isi face temele bine acasa va obtine rezultate mai bune la scoala? &lt;br /&gt;Victima: Desigur. &lt;br /&gt;Vanzatorul: Nu-i asa ca daca ai niste materiale de consultatie bune poti sa-ti faci temele mult mai bine? &lt;br /&gt;Victima: Fireste. &lt;br /&gt;Vanzatorul: Perfect. Iata ca tocmai ne-au sosit cateva carti de studiu individual care par sa fie facute pentru copiii dvs. Cate doriti? &lt;br /&gt;Victima: aaa... iii... aaa... &lt;br /&gt;Desigur, intotdeauna este posibil sa refuzati cumpararea, dar intr-un astfel de caz este mult mai greu decat daca vanzatorul ar fi prezentat direct oferta lui. &lt;br /&gt;&lt;span style="font-weight:bold;"&gt;COERENTA INTERNA SI IMAGINEA DE SINE&lt;/span&gt; &lt;br /&gt;De ce Legea Coerentei este asa de puternica? &lt;br /&gt;Pentru ca, daca imi retrag afirmatia facuta inainte sau actionez in contradictie cu ceea ce am spus, imi pot pierde reputatia de om serios si increderea celorlalti. &lt;br /&gt;Sunt insa persoane pentru care aceste lucruri nu sunt chiar asa de importante (cu totii cunoastem persoane care obisnuiesc sa spuna ceva si sa faca altceva). &lt;br /&gt;Dar chiar si pentru acestea exista o coerenta care trebuie respectata, mult mai puternica: cea interioara. &lt;br /&gt;Coerenta interioara se refera la faptul ca eu nu pot actiona impotriva imaginii pe care o am despre mine. &lt;br /&gt;Daca se intampla asa ceva, se produce o stare de disconfort psihic (numita disonanta cognitiva), care trebuie rezolvata cat mai repede. &lt;br /&gt;Asa ca daca eu reusesc sa ma folosesc de imaginea pe care o aveti despre voi, pot sa obtin practic orice de la voi. &lt;br /&gt;Cunoscand Legea Coerentei, devine foarte clar de ce comerciantii organizeaza concursuri la care, pentru a castiga, trebuie sa faceti o compunere in care sa descrieti calitatile unui anumit produs. &lt;br /&gt;Ca sa puteti scrie ceva decent, evident, va veti angaja sa gasiti calitatile pozitive ale produsului respectiv. &lt;br /&gt;Pe urma, procedand coarent, o sa va supuneti influentei a ceea ce ati scris si o sa deveniti un fidel cumparator (chiar daca nu ati castigat concursul). &lt;br /&gt;Alta tactica foarte folosita este cea in care sunteti pus deliberat intr-o stare de disonanta, solutia fiind sa cumparati sau sa faceti ce vrea manipulatorul. Exemplu: &lt;br /&gt;Manipulatorul: Nu-i asa ca statul nu este in stare sa asigure pensii decente pentru batrani? &lt;br /&gt;Victima: Da, asa este. Iata cateva exemple: &lt;br /&gt;- Craciunul tocmai a trecut. Cate cadouri ati facut din placere si cate pentru ca trebuia? &lt;br /&gt;Si nu s-a intamplat cumva, dandu-va seama ca darul pe care vi la facut cineva este mult mai scump decat al vostru, sa va simtiti obligati sa cumparati ceva suplimentar, pentru a anula diferenta? &lt;br /&gt;- Este destul de usor sa-l refuzam pe cersetorul care ne cere bani de pomana, fara sa ne dea nimic in schimb; dar este mult mai greu sa procedam la fel cu cel care ne "curata" parbrizul masinii la semafor. Sau, daca cineva va invita la cina sau va aduce un cadou si apoi va cere un serviciu - cat de mult creste probabilitatea de a accepta, fata de cazul in care cererea v-ar fi fost facuta direct? &lt;br /&gt;- Multe firme ofera gratuit esantioane din produsul pe care-l vand. Explicatia oficiala este ca i se da astfel publicului posibilitatea de a proba si de a se familiariza cu produsul. In realitate, esantionul gratuit constituie un cadou si se apeleaza astfel la LEGEA RECIPROCITATII: probabilitatea ca beneficiarul cadoului sa cumpere produsul creste enorm. &lt;br /&gt;&lt;strong&gt;Tehnica "retragere dupa refuz"&lt;/strong&gt;&lt;br /&gt;Acum as vrea sa vorbesc despre un caz particular al LEGII RECIPROCITATII, anume despre concesiile reciproce din timpul unei negocieri ("negociere" este inteleasa la modul general, de la o discutie intre tata si fiu, pana la tratativele internationale): &lt;br /&gt;daca eu dupa ce initial am cerut o favoare foarte mare, imi scad pretentiile, acestea imi vor fi indeplinite mult mai usor decat daca ele ar fi constituit obiectivul cererii initiale. &lt;br /&gt;Cand este folosita bine, aceasta tehnica (numita "retragere dupa refuz") poate fi extraordinar de eficienta, datorita faptului ca la forta LEGII RECIPROCITATII se adauga cea a LEGII CONTRASTULUI, despre care am vorbit in postul trecut. &lt;br /&gt;Sa vedem cateva exemple: &lt;br /&gt;- Daca aveti nevoie de un imprumut de 100 $, e bine sa cereti la inceput 200 $; in primul rand pentru ca, scazand pretentiile, dati impresia ca renuntati la ceva, astfel ca celalalt are o obligatie fata de voi; apoi, pentru ca dupa ce ati vorbit de 200 $, 100 $ pare mult mai putin; si, nu in ultimul rand, pentru ca exista posibilitatea ca celalalt sa spuna "da" de la inceput, voi obtinand astfel dublul sumei de care aveti nevoie. &lt;br /&gt;- daca sunteti vanzatori, atentie: cand aratati produsele, incepeti intotdeauna cu cele mai scumpe. Chiar daca instinctul va indeamna sa faceti exact pe dos, cercetarile au demonstrat ca, procedand astfel, volumul vanzarilor aproape se tripleaza. Evident, cand aratati produse din ce in ce mai ieftine, pretul pare din ce in ce mai mic si cumpararea este favorizata si, oricum, clientul poate cumpara direct produsul cel mai scump (acum ne este clar ca, daca procedam invers, regula actioneaza impotriva noastra). &lt;br /&gt;- Apropo de vanzatori, adevaratii profesonisti folosesc LEGEA RECIPROCITATII chiar si atunci cand nu reusesc sa va vanda ceva. &lt;br /&gt;Ei nu va lasa sa plecati pur si simplu, ci va cer nume de prieteni sau de rude care ar putea fi interesate de produsele lor.&lt;br /&gt;Ca o concluzie, daca nu vreti sa fiti manipulati, trebuie sa intelegeti ca dusmanul adevarat este felul in care raspundeti la diverse actiuni. Cum sa procedam ca sa nu cadem, la randul nostru, in plasa altora?&lt;br /&gt;"Un tinar novice si un calugar se plimbau prin gradina manastirii, citind si comentand impreuna diferite pasaje din Biblie. La un moment dat au simtit nevoia unei tigari, dar, nestiind daca incalca vreo regula fumand in timpul studiului, s-au hotarit sa ceara, dupa masa, permisiunea parintelui staret. Cand s-au intilnit a doua zi, calugarul fuma linistit, spre nedumerirea novicelui:&lt;br /&gt;"Frate, mie staretul mi-a interzis sa fumez, tie cum de ti-a permis?"&lt;br /&gt;"Nu stiu... Tu ce i-ai spus?"&lt;br /&gt;"I-am cerut sa-mi dea voie sa fumez in timp ce citesc Biblia."&lt;br /&gt;"Vezi, aici ai gresit. Eu i-am cerut sa-mi dea voie sa citesc Biblia in timp ce fumez."&lt;br /&gt;De ce o cerere formulata intr-un anumit mod este respinsa pe cand aceeasi cerere, formulata intr-o alta maniera este aprobata?&lt;br /&gt;Ce determina o persoana sa accepte dorintele noastre? Si ce ne impinge pe noi sa acceptam dorintele altora, deseori fara nici o placere si impotriva interesului nostru, pierzind adesea timp si bani?&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;Legea Contrastului&lt;/span&gt;&lt;br /&gt;Aceasta lege spune ca doua lucruri diferite par si mai diferite atunci cand sunt puse alaturi sau, alt sens, un lucru poate capata dimensiuni diferite in functie de contextul in care este plasat (de exemplu, viteza de 100 km/h ne va parea mai mare sau mai mica, dupa modalitatea in care o atingem: accelerand de la 40 km/h sau incetinim de la 150 km/h).&lt;br /&gt;Frumusetea acestei legi consta in faptul ca ea functioneaza nu numai perfect, ci si insesizabil. Cine o foloseste poate profita din plin de noi fara a avea nici un moment aerul ca o face. Nu credeti?&lt;br /&gt;Stiti ce mi-a spus patronul unei agentii imobiliare?&lt;br /&gt;"Pastrez mereu in oferta 2-3 apartamente oribile la preturi umflate, in oricare zona a orasului, si pe acestea le prezint clientilor la prima lor vizita. Dupa ce vad aceste porcarii, casa pe care intr-adevar vreau sa le-o prezint li se pare minunata!"&lt;br /&gt;Alt exemplu: un seminar de 3 zile in Statele Unite poate ajunge la 2.000 $, excluzìnd cheltuielile de cazare si de masa, dar o video caseta care prezinta aceleasi lucruri poate fi achizitionata pentru "doar" 200 $. Fata de prima suma, a plati 200 $ pentru o videocaseta nu pare prea mult.&lt;br /&gt;Sau, sa zicem ca vreti sa cumparati o masina cu 10.000 $. Dupa ce va lasa sa va acomodati cu aceasta cifra, vanzatorul incepe sa va arate, pe rand, si dotarile suplimentare: radio (200 $), telecomanda (100 $), alte facilitati (150 $) si, in final, vine fraza:&lt;br /&gt;"Nu puteti lasa o asemenea masina fara sistem antifurt. &lt;br /&gt;- Sunt absolventi de facultate; &lt;br /&gt;- Au beneficiat de o atentie deosebita în familie (de regula, sunt copii singuri la parinti); &lt;br /&gt;- Au început sa câstige bani înca din adolescenta; Este usor sa atribuim succesul lui Microsoft unei extraordinare sanse - obtinerea contractului cu IBM pentru furnizarea sistemului de operare pentru primul PC. Insa aici este mai mult decat norocul, Gates a intuit importanta afacerii cu IBM pentru istoria calculatoarelor. A muncit din greu mai mult de sase luni pentru a-si maximiza sansele de a fi „norocos”.&lt;br /&gt;&lt;br /&gt;2. &lt;strong&gt;Indragosti-va de tehnologie&lt;/strong&gt;. Un aspect foarte important al succesului au fost cunostintele tehnologice ale lui Gates. In multe ocazii el a vazut directia viitoare a tehnologiei mai clar decat concurentii sai.&lt;br /&gt;&lt;br /&gt;3. &lt;strong&gt;Nu luati prizonieri&lt;/strong&gt;. Gates este un concurent de temut. In tot ce face cauta sa castige, este un negociator foarte dur. Nu face nici un secret din asta si vorbeste deschis despre zdrobirea concurentilor.&lt;br /&gt;&lt;br /&gt;4. &lt;strong&gt;Angajati oamenii foarte destepti&lt;/strong&gt;. „Oameni cu IQ ridicat” este un termen folosit la Microsoft pentru referirea la oameni foarte destepti. Inca de la inceput, Gates a insistat ca intotdeauna Microsoft necesita cele mai stralucite minti. Nu-i prea suporta pe cei care nu se pricep la tehnologie. In unele cercuri aceasta tendinta a fost catalogata ca fiind elitista si a provocat critici. Compania recruteaza multi studenti destepti direct din facultate, studenti atrasi de perspectiva de a lucra cu cel mai bun.&lt;br /&gt;&lt;br /&gt;5. &lt;strong&gt;Invatati sa supravietuiti&lt;/strong&gt;. Gates admite ca majoritatea luptelor comerciale cu concurentii sai au fost pierdute de acestia datorita propriilor greseli. Gates evita capcanele in care cad ceilalti, exploatand totodata oportunitatile ce apar din greselile altora.&lt;br /&gt;&lt;br /&gt;6. &lt;strong&gt;Nu asteptati multumiri&lt;/strong&gt;. Bill Gates cunoaste importanta faptului de a avea prieteni sus-pusi. In ciuda bataliilor continue cu agentiile de reglementare antitrust ale SUA, Gates a atras simpatia presedintilor a celor mai importante 500 companii, organizand adunari pentru acestia.&lt;br /&gt;&lt;br /&gt;7. &lt;strong&gt;Asumati-va pozitia vizionarului&lt;/strong&gt;. Gates este un nou tip de lider in afaceri. De-a lungul anilor a aratat in mod repetat ca este un clarvazator in industria calculatoarelor. Intelegerea profunda a tehnologiei ca un mod unic de sintetizare a datelor ii acorda abilitatea speciala de a prevedea orientarile viitoare si de a elabora strategia Microsoft.&lt;br /&gt;&lt;br /&gt;8. &lt;strong&gt;Acoperiti toate domeniile de baza&lt;/strong&gt;. Un element cheie al succesului Microsoft il reprezinta abilitatea sa de a derula simultan un numar important de proiecte. Gates este primul dintre persoanele care au multe de facut si se spune ca poate sa intretina mai multe conversatii tehnice in acelasi timp. Aceasta abilitate remarcabila este reflectata in orientarea companiei; ceea ce inseamna ca exploreaza continuu noi piete si noi aplicatii soft; acestea il apara sa nu scape urmatoarea „mare descoperire”.&lt;br /&gt;&lt;br /&gt;9. &lt;strong&gt;Construiti o afacere de mici dimensiuni&lt;/strong&gt;. In comparatie cu cifra de afaceri si evaluarea pe piata a actiunilor sale, Microsoft ramane o companie relativ mica. De asemenea, pe plan intern compania se imparte in mod constant in unitati mai mici pentru a mentine mediul optim de lucru in echipa. Ori de cate ori simte ca liniile de comunicatie devin prea lungi sau neclare, nu are nici o ezitare in a simplifica structura.&lt;br /&gt;&lt;br /&gt;10. &lt;strong&gt;Nu va luati niciodata ochii de pe minge&lt;/strong&gt;. Gates se afla in fruntea industriei soft de mai mult de doua decenii. In acest timp el a devenit cel mai bogat om din lume. Greselile pe care le poate face un întreprinzator la debutul si pe parcursul derularii unei afaceri sunt diverse, unele devenind chiar fatale pentru viitorul afacerii. Cu toate acestea, exista unele greseli tipice pe care le poate face un întreprinzator. Vom încerca sa-ti sugeram câteva exemple cu recomandarile de rigoare:&lt;br /&gt;&lt;p&gt;1. Greseala: Aptitudinile si calificarea profesionala ale întreprinzatorului sunt insuficiente Recomandare: Verifica în mod autocritic aptitudinile tale personale ca si calificarea ta profesionala&lt;/p&gt;&lt;p&gt;2. Greseala: Nu exista o strategie clara de piata Recomandare: Analizeaza cu exactitate piata si posibilitatile de desfacere.&lt;br /&gt;&lt;/p&gt;3. Greseala: Insuficienta cunoastere a competitorilor&lt;br /&gt;Recomandare: Analizeaza cu exactitate competitorii si dimensiunea acestora.&lt;br /&gt;&lt;p&gt;4. Greseala: Alegerea gresita a formei de lansarea a afacerii Recomandare: Analizeaza ce este mai indicat: înfiintarea unei firme noi sau preluarea uneia existenta. &lt;/p&gt;&lt;p&gt;5. Greseala: Cunostintele cu privire la organizarea interna a firmei sunt insuficiente Recomandare: Alege cea mai potrivita forma de organizare pentru firma ta si totodata fixeaza responsabilitati pentru fiecare angajat. &lt;br /&gt;&lt;/p&gt;&lt;p&gt;6. Greseala: Dependenta excesiva de anumiti furnizori Recomandare: Alegeti cu grija viitorii colaboratori.&lt;/p&gt;&lt;p&gt;7. Greseala: Capacitate insuficienta de recrutare si selectie a personalului Recomandare: Apeleaza la specialisti în domeniu &lt;br /&gt;&lt;/p&gt;8. Greseala: Necunoasterea reglementarilor legale Recomandare: Studiaza cu atentie reglementarile în viguare sau apeleaza la un consultant pentru a te consilia. &lt;p&gt;9.Greseala: Tentatia de a „stoarce” cât mai multi bani din propria afacere. Recomandare: Dezvolta propria afacere reinvestind profitul. &lt;/p&gt;&lt;p&gt;10. Greseala: Alegere necorespunzatoare a amplasamentului Recomandare: Alegeti cu grija amplasamentul si dotarile. Verifica posibilitatile de utilizare ale tehnicii de calcul. Auto-evaluarea&lt;/span&gt;&lt;br /&gt;Înainte de a începe elaborarea oricaror planuri privind afacerea pe care ai dori sa o desfasori în viitor, trebuie sa ai în vedere câteva elemente care tin atât de contextul economic în care va functiona afacerea ta, cât si de motivatiile proprii si ale familiei tale.&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;Pasul 2. Identificarea ideii de afaceri&lt;/span&gt;&lt;br /&gt;Va trebui sa gasesti în primul rând ideea de afacere care îti va aduce în viitor bani. Sursele principale de inspiratie pot fi: experientei anteriore de munca, hobby-urile, interactiunile sociale, evolutiile macroeconomice.&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;Pasul 3. Evaluarea ideii de afaceri&lt;/span&gt;&lt;br /&gt;Dupa identificarea oportunitatilor de afaceri este necesara o evaluare aprofundata a acestora, pentru a evita multe situatii în care subiectivismul întreprinzatorului poate fi fatal afacerii. Investigarea cu atentie a oportunitatii de afaceri sporeste foarte mult sansele de câstigare a încrederii unor potentiali investitori.&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;Pasul 4. Lansarea în afaceri&lt;/span&gt;&lt;br /&gt;Dupa ce ai evaluat ideea de afacere va trebui sa te gândesti la modalitatea de lansare a afacerii. Ai trei posibilitati: initierea unei afaceri noi, cumpararea unei afaceri existente, concesionarea (franciza). Înfiintarea unei noi firme este solutia aleasa cel mai frecvent de întreprinzatorul care ia decizia de a initia o noua afacere.&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;Pasul 5. Înregistrarea firmei&lt;/span&gt;&lt;br /&gt;Dupa depunerea dosarului, se realizeaza urmatoarele activitati:&lt;br /&gt;- Autorizarea constituirii comerciantului de catre judecatorul delegat;&lt;br /&gt;- Obtinerea, pe cale elctronica, a codului unic de înregistrare de la Ministerul Finantelor Publice;&lt;br /&gt;- Redactarea încheierii judecatorului delegat;&lt;br /&gt;- Înregistrarea comerciantului în registrul comertului;&lt;br /&gt;- Editarea certificatului de înregistrare.&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;Pasul 6. Autorizarea functionarii firmei&lt;/span&gt;&lt;br /&gt;Aceste activitati sunt realizate dupa data depunerii dosarului la Biroul Unic si pâna la data eliberarii anexei continând avizele, autorizatiile, acordurile necesare functionarii: autorizatia PSI, sanitara, sanitar-veterinara, pentru protectia muncii, pentru protectia mediului etc.&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;Pasul 7. Notificarea catre institutiile publice&lt;/span&gt;&lt;br /&gt;Efectele juridice ale etapelor obligatorii din procedura de înregistrare a unei firme sunt:&lt;br /&gt;- Semnarea actului constitutiv de catre asociati reprezinta etapa consensuala, care produce efecte între partile semnatare.&lt;br /&gt;- Autorizarea legalitatii constituirii unei societati comerciale revine&lt;br /&gt;judecatorului delegat. Acesta autorizeaza constituirea comerciantului persoana juridica si dispune înregistrarea în registrul comertului.&lt;br /&gt;- Înregistrarea (înmatricularea) societatii comerciale în registrul comertului are rol constitutiv. Iar daca e sa oferi informatie gratuita, de ce sa nu scrii despre produsele sau serviciile pe care le oferi.&lt;br /&gt;Dar pagina ta de internet, ea la ce se refera?&lt;br /&gt;-daca e despre animale, poti sa oferi detalii gratuite despre ingrijirea unei anumite rasa;&lt;br /&gt;-daca e despre web design ofera un curs despre avantajele internetului sau despre paginile web;&lt;br /&gt;-daca e despre produse cosmetice, atunci ofera un curs despre ingrijirea tenului sau a parului, de exemplu;&lt;br /&gt;Iar, in ceea ce priveste scrisul, raspunde-mi la urmatoarea intrebare:&lt;br /&gt;Stii sa vorbesti?&lt;br /&gt;“Normal ca stiu, ce intrebare e asta?!”&lt;br /&gt;Atunci nu ai de ce sa-ti faci probleme. Vei vedea ca nu e asa de greu cum ti se pare si nici nu trebuie sa urmezi cursuri de specialitate. afacere?</title><content type='html'>&lt;span style="font-weight:bold;"&gt;Aspecte juridice&lt;/span&gt;&lt;br /&gt;Atunci când ai o idee de afacere si dupa ce ai evaluat-o si esti convins ca vei avea succes nu ramâne decât sa o pui în practica.Înainte de a porni la drum, o conditie necesara este sa cunosti legislatia în vigoare care reglementeaza activitatea domeniului unde vrei sa functionezi.&lt;br /&gt;Cele mai importante pot fi gasite la adresele:&lt;br /&gt;http://www.mimmc.ro/imm/legislatie&lt;br /&gt;http://www.onrc.ro/romana/legislatie.php&lt;br /&gt;Resurse legislative pentru infiintarea firmei, necesare pentru inregistrare si autorizare:&lt;br /&gt;- Codul CAEN – Ordinul nr. 337/20.04.2007 ultima actualizare a activitatilor din economia nationala conform CAEN rev. 2, util pentru alegerea activitatilor pe care le va desfasura comerciantul persoana fizica sau juridica;&lt;br /&gt;- Legea nr. 31/1990 privind societatile comerciale, cu modificarile si completarile ulterioare - este baza functionarii legale a unei societati comerciale;&lt;br /&gt;- Legea nr. 26/1990 privind registrul comertului, cu modificarile si completarile ulterioare - utila pentru alegerea firmei/emblemei comerciantului persoana fizica sau&lt;br /&gt;juridica si pentru efectuarea procedurilor de inregistrare la Registrul Comertului.&lt;br /&gt;-Norme metodologice nr. 608/15.04.1998 privind modul de tinere a registrelor comertului si de efectuare a inregistrarilor, emise de Camera de Comert si Industrie a Romaniei;&lt;br /&gt;- H.G. nr. 166/2003 privind acordarea unor facilitati fiscale studentilor care doresc sa înfiinteze o afacere proprie;&lt;br /&gt;- Legea nr. 346/14.07.2004 privind stimularea infiintarii si dezvoltarii intreprinderilor mici si mijlocii;&lt;br /&gt;- Legea nr. 161/2003 privind unele masuri pentru asigurarea transparentei în executarea demnitatilor publice, a functiilor publice si în mediul de afaceri, prevenirea si sanctionarea coruptiei, Titlul V - Cartea I, privind G.I.E. (grupurile de interes economic), cu modificarile si completarile ulterioare;&lt;br /&gt;- HG nr. 616/2001 privind aprobarea taxelor percepute pentru publicarea în Monitorul Oficial al României, Partea a IV-a, a încheierii judecatorului delegat la înregistrarea comerciantilor si a actului constitutiv, vizat de judecatorul delegat;&lt;br /&gt;Resurse legislative necesare ulterior infiintarii firmei, pentru modificarea actelor constitutive si pentru desfasurarea legala a propriei afaceri:&lt;br /&gt;- Codul comercial;&lt;br /&gt;- OG nr. 5/2001 privind procedura somatiei de plata;&lt;br /&gt;- Codul de procedura civila, Cap. XIV “Dispozitii privind solutionarea litigiilor in materie comerciala“&lt;br /&gt;- Lege nr. 99 din 26/05/1999 privind unele masuri pentru accelerarea reformei economice;&lt;br /&gt;- Legea nr. 571/2003 privind Codul fiscal ;&lt;br /&gt;- Legea nr. 469/09.07.2002 privind unele masuri pentru intarirea disciplinei&lt;br /&gt;contractuale;&lt;br /&gt;- Legea nr. 11/1991 privind combaterea concurentei neloiale;&lt;br /&gt;De asemenea, este foarte important sa cunosti aspecte legate de legislatia fiscala în vigoare.&lt;br /&gt;Prima lege ca importanta este Legea nr. 31/16 noiembrie 1990 privind societatile comerciale, unde vei putea cunoaste aspecte importante privind organizarea firmei pe care vrei sa o înfiintezi.&lt;br /&gt;Alta lege cu importanta în organizarea unei firme este: Legea nr. 133/ 20 iulie 1999 privind stimularea întreprinzatorilor privati pentru înfiintarea si dezvoltarea întreprinderilor mici si mijlocii.&lt;br /&gt;Dupa ce vei alege forma de organizare a firmei, va trebui sa stii ce impozite trebuie sa platesti. Ai putea scrie 10 pagini despre asta?&lt;br /&gt;Daca nu, inseamna ca ai doar vise vagi, nu teluri concrete.&lt;br /&gt;Sa vedem, atunci, cum poti sa devii mai exact cand vine vorba de ceea ce vrei de la viata.&lt;br /&gt;&lt;strong&gt;&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Pasul intai&lt;/strong&gt;: ia o decizie.&lt;br /&gt;Totul incepe cu o decizie. Daca esti superficial cand vine vorba de ceea ce vrei, vei renunta pe parcurs. Ia o decizie ca vrei sa schimbi anumite aspecte ale vietii tale.&lt;br /&gt;&lt;strong&gt;Pasul al doilea&lt;/strong&gt;: stablieste toate aspectele vietii tale in care ai vrea sa evoluezi/sa iti mearga mai bine.&lt;br /&gt;1. Un job mai bun?&lt;br /&gt;2. Vrei sa ai mai multi bani?&lt;br /&gt;3. (completeaza sau inlocuieste aceasta lista cu ceea ce e valabil pentru tine)&lt;br /&gt;Hotaraste-te EXACT cum vrei sa arate viata ta cand vine vorba de acel aspect.&lt;br /&gt;Vrei sa fii platit mai bine? Gandeste-te de ce nu esti deja platit bine? E din cauza ca firma nu o duce bine financiar, sau poate din cauza ca TU nu muncesti destul sau nu esti destul de serios? Trece totul pe hartie dupa ce ai analizat bine.&lt;br /&gt;&lt;strong&gt;Pasul al treilea&lt;/strong&gt;:&lt;br /&gt;Odata ce ai stabilit cu exactitate ceea ce vrei, e momentul sa stabilesti ce trebuie sa faci pentru a-ti transpune fiecare vis in realitate. Care este primul pas? Care este al doilea? Incearca sa vezi daca planurile pe care ti le faci sunt realizabile si daca da, cu ce pret.&lt;br /&gt;&lt;strong&gt;Pasul al patrulea&lt;/strong&gt;:&lt;br /&gt;Stabileste un plan de actiune. Si aici, exactitatea este esentiala. Pentru a nu abandona vreunul din vise, este necesar sa lucrezi regulat la el. Daca nu ai facut nimic sa avansezi timp de o luna de zile, inseamna ca ai uitat de ce ti l-ai dorit de la bun început. Nu e nimic neobisnuit in a renunta la unele lucruri pe care ti le doreai - situatii noi, oameni noi, vise noi. Daca, totusi, se intampla sa renunti la majoritatea planurilor, poate ca visele tale nu sunt destul de mari. Sau, poate ca sunt prea mari, atat de mari incat te-au intimidat odata ce te-ai pus pe treaba.&lt;br /&gt;&lt;strong&gt;Pasul al cincilea&lt;/strong&gt;:&lt;br /&gt;Nu mai ramane decat sa te apuci de treaba, si sa te tii de planul de actiune stabilit in detaliu la punctul patru. Aici trebuie sa tii cont de ceva: in timp, entuziasmul pe care il ai acum o sa dispara. Deci e bine sa nu iti faci planuri gen merg la sala de sapte ori pe saptamana daca idealul tau este sa te mentii sanatos, iar pe langa asta mai ai de facut in medie 100 de lucruri in fiecare zi.&lt;br /&gt;&lt;br /&gt;Cum s-ar desfasura o zi din viata ta cap-coada, daca ar fi sa te tii de planul tau de actiune cu strictete? Daca ajungi la concluzia ca ai ajunge sa dormi 3 ore pe noapte atunci… e mai bine sa lasi mai moale si sa ridici stacheta pe parcurs.&lt;br /&gt;Pare simplu dar, daca urmezi acesti cinci pasi vei ajunge foarte departe.
